Illinois Concealed Carry License Cases


IL CONCEALED CARRY PERMIT

On January 5th, 2014, Illinois state law enforcement agencies started accepting applications for concealed carry permits for handguns. . As the last state to allow citizens to legally carry concealed handguns, Illinois has fought against citizens’ rights to carry by having some of the most restrictive gun laws in the country. It was with great controversy, and fanfare, that Illinois decided to join the other 49 states and allow law-abiding citizens their 2nd Amendment rights to bear arms. The issue was hotly contested and was opposed by many politicians, prosecutors, and law enforcement organizations. The battle may be over but opposition still continues as applicants are getting denied as a result of new Illinois concealed carry law and new Illinois concealed carry permit requirements that accompany it.

With the passage of the Illinois Firearm Concealed Carry Act on July 9, 2013, Illinois has become a “shall issue” state. This simply means that the applicant does not have to show any particular need for the permit. If you meet the qualifications, provide the required documentation, and pay the required fees, the state must issue you the concealed carry permit.

However, the state can deny an application for an Illinois concealed carry license for many reasons. The state has the power to deny concealed carry permits based on “discretionary” grounds. Which means that the permit can be denied based upon items they feel are relevant to your permit, or virtually any reason.

For example, a law enforcement agency can file an objection to an Illinois concealed carry permit applicant, even if all other criteria have been met. Law enforcement must only have a “reasonable suspicion” that the applicant is a danger to file such an objection.
